Bart Shooting Family Suing for 25mill(149)

OAKLAND, Calif. -- The family of Oscar Grant, the 22-year-old Hayward resident who died New Year's Day after being shot by a Bay Area Rapid Transit (BART) police officer, is suing BART for $25 million. The family's lawyer, veteran civil rights attorney John Burris, held a press conference Sunday and made the announcement that he planned on filing the $25 million-suit against BART the following day. At the same press conference, Burris also declared that the shooting warrants the police to consider criminal charges against the accused police officer, who BART officials have yet to name. Burris said he planned to request that the Alameda County District Attorney investigate the matter sometime this week. In a press release issued Sunday, Burris wrote: "Oscar Grant III's family is having this press conference to express their outrage at the senseless killing of Oscar Grant by a BART police officer on New Year's Day. Various video tapes of the incident, as well as numerous witnesses' accounts unequivocally show that Mr. Grant, age 22 and a resident of Hayward, was unarmed and presented no threat to the officer or anyone else at the time he was shot in the back while lying face down on the embankment at the Fruitvale BART station in Oakland." Later in the release: "Oscar Grant's mother, with whom he resided, lost a loving son and a very active member of a close knit family. Mrs. Johnson is in a state of shock and disbelief and wants something to be done. Sophina Mesa, the mother of Mr. Grant's four-year-old daughter, says that she and Mr. Grant have been a couple since high schgool and she was present with 'Oscar' the evening of the shooting but she was not a witness. She also says that 'Oscar' adored their daughter. Ms. Mesa says that their daughter has been crying a lot and repeatedly asks for her 'daddy.'" The shooting happened on the platform of the Fruitvale station in Oakland shortly after 2 a.m. Thursday. BART officials have implied the shooting was an accident, saying the officer's gun discharged while the police officer and four other officers responded to reports that two groups of young men were fighting on a train that had come from San Francisco and was en route to the Dublin/Pleasanton station. The train was stopped at the Fruitvale station so the officers could get on board and break up the fight. Burris said witnesses have told him only two people were fighting on the BART train, not two big groups of people. "When conduct like this occurs, there is a price to pay," Burris said Saturday. "Police have to be held accountable when they engage in this kind of unlawful conduct." BART officials have said Grant was unarmed and no weapons were recovered. BART officials said the officer responsible for the shooting has worked for BART for nearly two years. Throughout his career, Burris has filed numerous lawsuits against police departments on behalf of family members of people who have been shot and killed by officers. Burris will file the claim on behalf of Wanda Johnson, Grant's mother; his four-year-old daughter and Oscar Grant's estate. |

But it is amazing how not even one mention of this shooting has made national news.... Given the video this family is going to get every penny and maybe more and what is even more troubling is how all of these police departments all over the country (CA.,FL., MI.,IL.,etc.) can continue to pay out these milllions and millions and millions in Police Brutality settlements and then when money is needed for schools, job training, etc. these states 'cry broke'. Some of them are even now asking for federal "bailout" money of all of the rowdy drunken, meth-head whyte boys in this country why dont any them ever wind up "accidentally" gunned down by cops? Many of these whyte cops out here today are nothing but racist assassins - nothing but KKK - azs po-po's |

This, like many deaths at the hands of mis-guided police officers is not only a tragedy for the family of Oscar Grant, but the entire community to include the Police. Over the last several years we as a community have become to complacent about becoming and remaining organized. We can all share explicatives, discontentment, anger and disgust, however, unless we as a people move beyond complacency and apathy, and take charge over what happens in our community, we will see more of the same. The death of Oscar Grant while tragic, should serve as a catalyst for the community to organize not only around this injustice, but all injustice in the community. To include, Police, Lack of Opportunity, Gangs, Drug Dealers, and any other form of injustice that cast our young black men in to the mind set of others as Public Enemy #1. For all who have responded, and intend on responding to this heart breaking injustice, ask yourself, What can I do now and from now on to make a difference with this situation and other injustices in my community? We have to stop waiting for a Black Messiah to lead us Rather we must decide to awaken the leader from within. Stay Organized to fight those who demonstrate disregard for us and our community. |

This will end when we stand up and start shooting back. When African people become zealous about defending ourselves from our real enemy as oppose to killing one another, things will change and we will be a respected people. America and the White Supremist system only respects blood and money. We've sang, sat in, marched and prayed enough. That day is done!!! This decent young man (and even if he wasn't decent) did not deserve this. Like Sean Bell, like Abner Luwema, like Daryl Battle, like Amadu Diallo, like Rodney King and a slew of faceless men of color assaulted and murdered by police, did not deserve this. I strongly advice every African person on this planet to read "The Isis Papers: The Keys to the Colors" by Dr. Frances Cress Welsing. African peoples of the world need to wake the hell up! We're like an abused spouse that continues to believe our enemy will somehow give us our due and our proper justice. YOU HAVE GOT TO TAKE IT! Wake the hell up! I live for the day that you punk ass gang bangers stop terrorizing your communities and start standing up for them, which was your original intent. Wake up! There will be more incidents such as this; and as always it will be under reported. We have got to wake up and defend ourselves. There is no other way. When will African peoples of the world wake up and unite? When will we stop wallowing in our diaspora that has driven a wedge between us, be we from the Americas (North or South), the Caribbean, Europe or the Motherland (Africa)? Until we come together (Gay, Straight, Conservative, Liberal, Religious, Non-Religious, Able bodied or Not, Rich or Poor, etc., etc., ) we will not topple and overcome our common enemy.

This a terrible injustice. AMERICANS ALL OVER THIS COUNTRY ,SHOULD BE APPALED at this injutice .My heart goes out to this family during their hour of need and I pray for justice in this case. This was cold blooded murder of the worse kind and should be treated as such .The police officer who fired the fatal shot should be tried for capital murder and all of the other officers involved ,should be reprimanded for derelition of their sworn duty to uphold law by standing by and allowing this to happen.

In Greece, they riot to prevent the injustice from continuing. Here in the U.S. all we do is blog, talk about it, pray and continue to watch as the African-American male becomes one of the world's most endangered-species. Its sad animal species take precedence over human species and nothing is being done about about the injustice we've endured for almost a half-century. Even now with Obama in office, even more young black males are being executed. What about the black star athelete in TX where the cop claimed he committed suicide and NAACP found out differently? Here the police confiscated cell phones to cover-up their crime. $25 million can't replace a father, a husband or a son. We're not going to realize the genocide thats taking place until its too late. Lets wake up, speak up & take action. Stop sitting back watching our children die!

omg i feel so bad for that family and that poor baby is going to grow up with out her daddy because of the dam police and there racism it is sicking i am a white grandmother of 8 biracial children and hear wher we live we go thru the same bullshit my grandson is thrown to the ground and beaten up cause he is half black he is 7 years old and my 9 year old granddaughter was tied to a fence and beaten cause she is half black believe me i have been into many fights with my neighbors cause this i called police and they said oh they r just kids i told them thats bullshit do something if it was my grandkids doing this to those kids they would be locked up its a shame that these police think they can do as they want and kill people and get away with it and u know what they do its freaking bullshit i whole heartedly believe that the police that did this to that poor man and his family they should allow that wife mother father to OSCAR do to that officer what he did to that man exspecilly allow his child get even MY HEARY GOES OUT TO THE FAMILY OF OSCAR MY FAMILIES PRAYERS ARE WITH GOD BLESS YOUR FAMILY STAY STRONG THAT BABY NEEDS USE ALL

This is a horrible injustice and the police involved in the murder-and the cover up-should be proscecuted to the fullest extent of the law. The BART is claiming the shooting was an accident, when the video clearly shows this racist cop standing over the victim and shooting him in the back. I agree with you, the police are participating in the extermination of black males, and if something doesn't happen we're going to see even more of happening on a larger scale. The dust from the Sean Bell shooting hasn't even settled before these racist pigs took the life of another innocent black man. The last I heard, fighting on the train isn't a capital offense, and certainly not one that warrants death. My heart goes out to the victim and the victim's family. You know, I hate the police so much that ,when I hear of a cop being shot and killed, I praise God and turn to Cartoon Network. |

Several years ago here in The Bronx, N.Y., a Black transit cop accidently discharged his weapon during a confrontation with some drunken White boys on an elevated train station and he was fired immediately by the then Black police commissioner. Yet, very few White killer cops have been arrested or even immediately fired for killing Blacks and Hispanics without justification...!!! Police officers are only as safe as the community allow them to be..!! Know what I mean..??? LarryJ

They Dont Care About US Or Our Kids. As Long as You are black we can get anything done to us and the offenders get away peacefully! Look all over the world now you know why cops are getting killed they abuse their powers i don't like them and don't need them the only cop in the world is god he is who we have to answer to not racist white cops who are just out to shoot ever black man in the world and kiss every white guys butt. I dont feel sorry for the cops getting killed now becuase now a days as you see its either kill a cop or be killed by a cop for no damn reason. His gun accidently discharged? Bull he had no reason to stand up and pull his gun anyway! They arent going to fire him they may suspend him to make it look good then let him back. There is no justice for blacks police wasnt made to protect us it was made for the white folks just incase chicken george or kizzy get to close to them cause they dont want to catch the illness of our skin color. I also live in Oakland, CA. The Oakland Police Dept. seems to have a history of shooting people and no amount of lawsuits filed against this department makes them behave. Perhaps the Bart Police believe that they can also murder "suspects" and get away with it. From the very beginning of this shooting at the Bart Fruitvale Station, the Bart police have been trying to lie about what happened and cover up the facts. This shooting was witnessed by people of different races who were passengers on the train and at the station where it happened. There is no reason for this tragedy. The Oakland Police Dept. has some suspected criminal activity going on within their own department now. |

i have found that there are no more socialist that truly active for black america they have become americans and don't stand for anything that is right for their people. the public feels that we don't count. people form other country treat use like we are nothing and they have more rights than we do. we the black people have always stood for what is right. that is not saying we are perfect but we do believe in what is right and fought for the one most important thing all of our lives. every race has come and breed form under the black race and it is our race that will turn their back on us first. the devil comes to steal, kill, and destory, only when he brings about divison can he do that. my grandfather was indian, my mother was half indians and see how the indians treat the black peolpe after we woud help them. they are so high and mighty now i know that my grandfather is trning in his grave. blacks married other races the white man tell successful black that you are better than those people don't go back where you came from get the white woman so we can take all your money down line ask oj. can we not think for ourselves even if it's wrong thats ok, we have to grow by error and learning. they play word games with us and brain wash our people and it is destorying my people. it is hard to even help our people without them thinking that you are doing something wrong. i'm having to deal with so much garbage. i live in a area of this country where white is right and balck is not my civil rights have been violated medically abuse and feeling as if i'm in economical slavery in america and finding that this is with all race in america now. so we are not the ony ones but we treated the worst.
