Adrian Bailey: Suing Disney For Near Fatal Accident

Who would've ever thought starring in a Disney Broadway musical could be so life threatening?

Unfortunately that was the case for 51-year old actor-singer Adrian Bailey, who severely injured himself during a May 10 matinee performance of 'The Little Mermaid.'

Bailey fell through a trap door on the deck of a suspended boat prior to the start of the performance, which lead the actor to suffer from fractured wrists, a broken back, a shattered pelvis, a fractured sternum, several fractured ribs and a fractured foot.

All of this for Ariel?

Following the accident, a court petition was filed on May 14 with the Manhattan Supreme Court. Now the singing actor is filing a lawsuit against Disney.

Black Stars on Broadway

'American Idol' Season 1 finalist Tamyra Gray blazed a new trail on Broadway when she revamped the look of lead character Mimi, a drug addicted HIV positive spitfire in the Pulitzer Prize and Tony Award winning musical 'Rent.' It wasn't the first time around the track for the former Georgia pageant queen; she previously starred in the Indian inspired outing, 'Bombay Dreams.'

Academy Award winning film veteran Morgan Freeman made a return to The Great White Way in April 2008. The last time the 'Million Dollar Baby' actor appeared on the Broadway stage before: 1988's 'The Gospel at Colonus.' As Frank Elgin, the Memphis native took on a roll traditionally played by a white actor in the Mike Nichols-directed revival.

Hip-hop superstar Sean "Diddy" Combs won rave reviews as Walter Lee Younger in the 2002 revival of the classic play 'A Raisin in the Sun.'

Sexy 'Soul Food' star Boris Kodjoe stepped up his acting game by filling in for Terrence Howard during a break in production of the sell-out, all-black version of Tennessee Williams' play 'Cat on a Hot Tin Roof.' Though it was only two weeks, the former fashion model turned pin-up hunk received high marks for taking on the lead role as sexually tormented jock, Brick. He held his own alongside Tony Award winning thespians James Earl Jones, Phylicia Rashad and Anika Noni Rose.

'Law & Order' powerhouse S. Epatha Merkerson returned to her theater roots with her critically acclaimed turn in 'Bye, Bye Birdie.'

In 2007, Grammy Award winning diva Chaka Khan made her Broadway debut in the Oprah Winfrey-produced musical 'A Color Purple.'

Known as a scene-stealer in films such as 'What's Love Got to Do With It?' and 'Meet The Browns,' Kinloch, Missouri born powerhouse Jenifer Lewis returned to her Broadway roots with a starring role in the Tony Award winning best musical 'Hairspray.' The 'Jackie's Back' star was originally tapped to play the role of Motormouth Maybelle in the original workshop of the Jon Waters-inspired tour-de-force. But because of legal obligations with her role in the Lifetime series 'Strong Medicine,' she couldn't open the show. Now, in between major projects, she's taken on the role and is wowing sold out crowds.

Ousted 'American Idol' finalist Frenchie Davis got a career boost when she wowed sell-out crowds in Broadway's long-running musical 'Rent.'

For his Broadway debut, multi-platinum selling R&B superstar Usher Raymond had audience members wrapped around the block for autographs. In 2006, the 'Confessions' singer brought a new meaning to what was known as "usher" on Broadway with his razzle dazzle of a performance as lawyer Billy Flynn in 'Chicago.'

In 2004, TV star Wayne Brady made a splash on Broadway playing legal eagle Billy Flynn in the hit musical 'Chicago.'

In addition to filing legal action against the entertainment powerhouse, which also produces 'Mary Poppins' and 'The Lion King' on Broadway, Bailey has also named theater manufacture companies George Tsypin Design, Showman Fabricators Inc. and Niscon in the same suit.

According to 'Backstage' magazine, Bailey is seeking unspecified monetary compensation and argues that his injuries "were caused by the carelessness, negligence and recklessness of the defendants" and adds that there were inadequate "warnings and/or safety devices" that could have prevented his accident.

Sounds like Bailey may have a nice piece of change coming his way.

Despite taking legal action, Bailey's everyday living has changed drastically. So drastic that the Broadway actor is having difficulties caring for himself.

"My life has been changed forever. It will never be the same," he told the magazine. "My immediate goal is to somehow be able to walk up to my own apartment and care for myself. I try to stay positive. I look forward to being made whole some day and being fully compensated for my injuries."

1. I wish Adrian Bailey a speedy recovery and hope he wins his suit. I remember him from "Smokey Joe's Cafe" and he's an excellent performer.

2. I pray for this gentleman. I know his life is changed forever, not only physically, but mentally. Yeah, he will get a good sum of money, but money doesn't always fix things. You can have a lot of money in the bank but say to yourself, if I could only do what i was once able to do. God Bless.

5. Whoever did this article, you are ignorant. Money means nothing if you don't have your health. This man has been performing since way back in the early 80's. Disney had little regard for the dancer and actors in the Loin King, many back have been ruined I hear from that show. Bringing this kind of theatre which is like theme park theatre and making folks do it 8 times a week is crazy. It was bound to happen. I hope he wipes them off the face of the planet with punitive and monetary damages. It will never bring back the incredible talent this man has but he will at least be able to take care of himself. The union Actors equity should also be included in this because they allowed it to happen in the first place. I wish you well Adrian you will be fierce again. It may take time but it will happen.

6. I feel for you,but it sound's like you are following the advice of your lawyer"made whole again"is a legal term.Or 25% of what ever you recover.Get well soon.

Nate Chappelle at 11:55AM on Sep 30th 2008

7. Sounds like this actor will need the money to pay for his medical expenses and long-term care, not to go out and having a wild spending spree. His injuries are quite serious and his needs will require expensive treatment over the years ahead. Good luck to you sir.

9. Andrian has been a wonderful actor, dancer, singer who down has to learn just to walk again. I hope that he will be compensated. He is a professional.
I have worked with him and my heart goes out to this wonderful performer who has been hurt so badly.
Disney has a reputation of "not caring"...
I wish Andrian the very best and I pray that he will be compensated though as someone else said, one's physical health is one's lively hood.
Best to you Andrian!!

10. The good ole USA. Something happens and right away its someone else's fault. Lets sue for millions of dollars so I don't every have to work again in my life!

Lori at 4:34PM on Sep 30th 2008

11. O.K let me get this straight. He fell through the stage on broadway and is suing Disney? That makes no sense considering Disney doesnt even own broadway. That is just stupid

Sterlin at 4:43PM on Sep 30th 2008

12. A broken back!!! plus other injuries! wow! your life WILL never be the same. you should be compensated. same thing happened to me 2 years ago, however not as severe. I'm still trying to collect. treatments and medicines needed for the rest of my life are very expensive. it's very irrating.

peggy at 4:53PM on Sep 30th 2008

13. Yes, Kim, he probably did break his own back and shatter his own pelvis on purpose. JEEZ, some people that post in these comments are REALLY stupid and insensitive.

Sho at 4:55PM on Sep 30th 2008

14. I do sincerely feel bad for Adrian Bailey, but I'm just throwing this out there. While it's always fun to "stick it" to big companies like Disney, are they truely liable for a faulty or unmarked trap door? If the theatre manufacturing company that built the boat and installed the trap door are reputable companies, I don't see how the Disney Corporation did anything wrong.

Kathryn at 5:00PM on Sep 30th 2008

15. ADRIAN SHOULD BE WATCHING WHAT HE IS DOING AND HE OR THE OTHER WORKERS SHOULD'VE CHECK TO SEE IF THE DOOR WAS SECURE ENOUGH NOT TO FALL IN YET ALONE THE SUSPENSION. I HAVE SEEN ALOT OF PEOPLE GETTING HURT SIMILAR WAYS AND ALOT WORSE THEY DON'T SUE ANYONE FOR DAMAGES. ADRIAN JUST WANTS THE MONEY SINCE HE CANT AFFORD HE OWN MEDICAL PROBLEM HE JUST GOT INJURED HE SHOULDN'T ACT LIKE HE WILL NEVRER GET BETTER WHEN INJURED U CANT MOVE THE BODY PART THAT IS INJURED FOR AWHILE WITH REST N WHAT EVER ELSE THE DOC TELLS U TO DO U WILL GET BETTER OVER TIME AADRIAN MADE IT SOUND LIKE SOME CLICHE OF BEING HANDICAPP BONES TAKE A LONG TIME TO HEAL AND RECOVER. MAYBE HE HAS PROXY CREATE HARM TO ONESELF JUST TO GET ATTENTION IT COULDVE BEEN HIS WEIGHT TO SUSPENSIONS ARE MADE TO HOLD A CERTAIN AMOUNT OF WEIGHT MAYBE IT WAS A BAD SUSPENSION
